These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of New York applicable to agreements made and to be entirely performed within the State of New York, without regard to its conflict of law principles.
17. DISPUTE RESOLUTION
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms, you agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one party to the other.
Binding Arbitration
If the parties are unable to resolve a dispute through informal negotiations, the dispute will be finally and exclusively resolved by binding arbitration. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA").
Arbitration Location and Procedure
The arbitration shall take place in New York, unless both parties agree to a different location or to conduct the arbitration remotely via video conference. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Cost Allocation
Each party shall bear its own costs and attorneys' fees. The arbitration fees shall be allocated as follows:
- For claims under $10,000, we will reimburse your filing fees and pay the arbitrator's fees
- For claims over $10,000, arbitration fees shall be split equally between the parties, unless the arbitrator determines otherwise
Class Action Waiver
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Small Claims Court Exception
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
Injunctive Relief Exception
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or data security.
Opt-Out Right
You may opt out of this arbitration agreement within thirty (30) days of first accepting these Legal Terms by sending written notice to privacy@hale.med with the subject line "Arbitration Opt-Out." If you opt out, you and we will resolve disputes in accordance with the Governing Law section. Opting out will not affect any other terms of these Legal Terms.

- Text "HELLO" to 741741 (Crisis Text Line)
The Services are not designed to provide mental health crisis intervention, suicide prevention services, or emergency psychiatric care.
No Doctor-Patient Relationship
USE OF THE SERVICES DOES NOT CREATE A DOCTOR-PATIENT RELATIONSHIP, THERAPIST-PATIENT RELATIONSHIP, OR ANY OTHER HEALTHCARE PROVIDER-PATIENT RELATIONSHIP BETWEEN YOU AND HALE HEALTH, ITS EMPLOYEES, CONTRACTORS, OR AFFILIATES.
The Services do not provide direct access to licensed healthcare professionals for diagnosis, treatment, or medical care. Any information provided through the Services is generated by artificial intelligence technology and does not represent the professional medical judgment of a licensed healthcare provider.
Artificial Intelligence Limitations and Potential Errors
The Services use artificial intelligence (AI) and machine learning technologies to provide information and assistance. You acknowledge and understand that AI technology has inherent limitations and risks:
AI Can Make Mistakes
- AI responses may contain errors, inaccuracies, or outdated information
- AI may misinterpret your questions or provide irrelevant responses
- AI may fail to recognize serious medical conditions or symptoms
- AI-generated information may not reflect the most current medical research or treatment guidelines
- AI may "hallucinate" or generate plausible-sounding but incorrect information
Not Personalized Medical Care
- While Hale considers your medical history and information you provide, AI cannot replace the comprehensive evaluation and professional judgment of a healthcare provider who knows your complete medical situation
- AI cannot perform physical examinations, order diagnostic tests, or conduct the thorough assessments that healthcare providers perform
- AI responses are based solely on the information you provide and may not account for factors you haven't mentioned or that the system doesn't know about
Information May Be Incomplete or Outdated
- Medical knowledge evolves rapidly, and information may become outdated between system updates
- AI training data has a knowledge cutoff date and may not include recent medical discoveries or treatment changes
- The Services may not have access to your complete medical records or recent changes to your health status
Technology Limitations
- AI interpretation of medical terminology, lab results, or symptoms may be imperfect
- Natural language processing may misunderstand colloquialisms, abbreviations, or unclear descriptions
- System errors, bugs, or technical issues may affect the accuracy of responses
YOU ACKNOWLEDGE THAT AI TECHNOLOGY IS NOT INFALLIBLE AND AGREE TO:
- Verify any critical health information with your healthcare provider before acting on it
- Not rely solely on AI-generated information for important medical decisions
- Understand that AI responses are suggestions and starting points for discussion with your healthcare provider, not definitive medical answers
- Report any errors, inaccuracies, or concerning responses to us at privacy@hale.med
Medication and Treatment Warnings
DO NOT:
- Start, stop, or change any medications based solely on information from the Services
- Adjust medication dosages without explicit instruction from your healthcare provider
- Ignore symptoms or delay seeking medical care based on AI responses
- Use the Services to self-diagnose serious medical conditions
- Rely on the Services for comprehensive drug interaction checking without pharmacist or physician verification
- Mix medications or supplements without consulting your healthcare provider or pharmacist

MEDICATION INTERACTIONS:
While Hale may provide information about potential medication interactions based on your medication list, this information:
- Is not comprehensive and may not include all possible interactions
- Should not replace consultation with your pharmacist or physician
- May not account for your specific medical conditions, allergies, or other factors
- Should be verified before making any changes to your medication regimen
Always consult your healthcare provider or pharmacist before:
- Adding new medications or supplements
- Stopping any prescribed medications
- Changing the timing or dosage of medications
- Combining medications with food, alcohol, or other substances
Interpretation of Medical Results
Information provided about lab results, test results, medical reports, or diagnostic imaging through the Services is for educational purposes only and does not constitute medical interpretation, diagnosis, or clinical judgment.
Lab results and medical tests should always be reviewed with your healthcare provider, who can:
- Interpret results in the context of your complete medical history
- Order additional tests if needed
- Explain what results mean for your specific situation
- Recommend appropriate follow-up care or treatment
DO NOT:
- Make treatment decisions based solely on AI interpretation of lab results

- Ignore abnormal results without consulting your healthcare provider
- Delay follow-up appointments based on AI interpretation
Symptom Information
Information provided about symptoms through the Services is general educational information and should not be used for self-diagnosis.
Many serious medical conditions share similar symptoms with minor conditions. Only a qualified healthcare provider can properly diagnose medical conditions through:
- Complete medical history review
- Physical examination

- Professional clinical judgment
If you are experiencing new, worsening, or concerning symptoms:
- Contact your healthcare provider promptly
- Seek immediate medical attention if symptoms are severe or sudden
- Do not delay seeking care while waiting for AI responses
